Legal conditions

All purchases made at HERBITAS (https://herbitas.com) are subject to the general purchasing conditions set forth in this document. Sales generated both online and in physical stores are governed by the current Spanish health legislation.

Laboratorios Herbitas S.L. reserves the right to discontinue access, at any time and without prior notice, to any of the products offered on the website.

PRICE LISTS

The prices of the products applied in our online store include the taxes of the current Spanish legislation.

Regarding Value Added Tax (VAT), the tax rate will apply to the territory of the European Union where this tax is applicable. All companies belonging to European Union countries with an intra-community VAT number, except Spain, will be exempt from paying this tax. In sales to any other country in the world, VAT will not be charged; however, each country's customs systems will apply the corresponding tax burdens.

Due to its special tax regime, the geographical areas corresponding to the Canary Islands, Ceuta, and Melilla are considered extracommunity territories. Therefore, purchases made by residents of these territories are exempt from VAT payment (customs clearance fees and import taxes are not included in the item or shipping price and must be paid at the destination by the customer).

The prices and the only payment currency is the euro.

The prices displayed on https://herbitas.com may be reviewed and modified if conditions require it at any time.

The website herbitas.com, its prices, and images are subject to possible typographical errors. Laboratorios Herbitas SL will have the right to modify said error, inform the customer, and stop/cancel the purchase or management of the product until its correct change or replacement.

The user or consumer waives the right to claim any responsibility from herbitas.com, especially for any issues such as possible failures or typographical errors, as well as price errors, VAT, or images. Images are for guidance purposes. 


DELIVERY TIMES

For Spain:

Herbitas demands the utmost speed in delivering its orders. Our commitment to the customer is maximum, and therefore, deliveries are usually made within periods not exceeding 24-72 hours from when the order leaves our facilities.

The online store consists of more than 4,000 references, making it impossible to maintain a constant stock of all of them. Therefore, shipments may be delayed and exceed the 72 hours we set as a goal.

In holiday periods, deadlines may be extended.

For international and island shipments:

Delivery times may be extended by one or two weeks. We guarantee to provide quick information to our customers about estimated delivery times. Some products in our store are discontinued or with prolonged stock outages because our suppliers do not inform us in advance. In these cases, we will proceed to refund the amount of the product within a period not exceeding 48 hours.

 

WARRANTY

The warranty for products sold by Laboratorios Herbitas S.L. applies exclusively to professionals and self-employed workers, and falls outside the scope of Royal Legislative Decree 1/2007 on consumer protection. In these commercial relationships, the Civil Code and the Commercial Code apply, as well as this commercial warranty offered by the company.

  • Duration: Equipment and small devices are covered by a warranty of one (1) year from the date of delivery.
  • Coverage: The warranty covers non-conformity existing at the time of delivery and will be enforced by repair or replacement of the product, at the choice of Laboratorios Herbitas S.L. If both options prove impossible or disproportionate, a price reduction or termination of the contract may apply.
  • Notification of incidents: The buyer must notify Laboratorios Herbitas S.L. of any non-conformity detected within a maximum period of thirty (30) days from the moment it was discovered.
  • Disposable and single-use medical material: Due to their immediate consumption nature, these products are not subject to warranty. However, Laboratorios Herbitas S.L. guarantees conformity at the time of delivery and will respond in the event that the material is delivered defective, damaged or expired.

Laboratorios Herbitas S.L. reserves the right to verify whether the defect was caused by a manufacturing fault or by misuse. Consumable parts such as batteries, hydraulics, motors, cables, batteries, bulbs, fuses, etc., as well as accessories, are not covered by the warranty.

During the repair or review period, the company will not replace the product and no compensation will be granted.

Laboratorios Herbitas S.L. reserves the right to request an official brand technical service to verify the origin of the problem. If the defect results from misuse, the repair will be chargeable.

To make use of the warranty, it must be previously communicated to our after-sales service department. No merchandise will be accepted in our warehouses without prior authorization for exchange, return or repair. See instructions in section 5.

The warranty applies only to the holder (contractual party) indicated on the invoice, and only the holder may claim it.

The warranty will become void:

- In case of improper use due to not following the product manual or inadequate maintenance.

 - If any data on the warranty or proof of purchase is modified, altered or replaced.

 - If the guaranteed device is tampered with or repaired without the knowledge of the Technical Service.

 - If there is no invoice.

 - In case of power surges or connection to an improper voltage.

SHIPPING COSTS

In commercial relations between Laboratorios Herbitas S.L. and professionals or self-employed workers, the free shipping regime provided for in Article 120 of Royal Legislative Decree 1/2007 does not apply, as that legal framework is limited to final consumers.

Consequently, the following is established:

  • In the case of repairs to equipment and electronic devices, transportation and shipping costs will be borne by the client, even if the product is still under warranty.
  • Only when the return is due to the delivery of a defective, damaged or expired product, and provided that the client notifies it within 30 days from delivery, will Laboratorios Herbitas S.L. assume the transport costs associated with the return and replacement.
  • For all other incidents, including those resulting from misuse, incorrect handling or natural wear and tear, shipping and associated costs will be the responsibility of the client.

 

LIMITATION OF LIABILITY

It is the customer's responsibility to be technically qualified to use the materials distributed by Laboratorios Herbitas

 

PROTECTION OF PERSONAL DATA

In accordance with current personal data protection regulations, the Regulation (EU) 2016/679 of April 27, 2016, concerning the protection of natural persons with regard to the processing of personal data and the free movement of such data (hereinafter, GDPR), and Organic Law 3/2018, of December 5, on the Protection of Personal Data and the guarantee of digital rights (hereinafter, LOPDGDD), we inform you that Laboratorios Herbitas, S.L. will process your personal data to manage contact with you and facilitate the provision of services based on the pre-contractual or contractual relationship. In addition, if you are a customer, you may receive commercial electronic communications about similar products that were subject to contracting. Your personal data will be kept for the necessary time to comply with corresponding legal obligations. We inform you that you may exercise the rights of access, rectification, deletion, objection, restriction, or portability of the processing by contacting lopd@herbitas.com or at the Address: Periodista Badía, 13B.  46134 Foios -  Valencia (Spain). If you believe that the data processing does not comply with current regulations, you may file a complaint with the supervisory authority at  www.agpd.es.

 

LEGISLATION AND JURISDICTION

These general conditions will be interpreted in accordance with current Spanish legislation, which will apply subsidiarily to everything not provided for in them. (Mainly Law 34/2002 of July 11 on information services and electronic commerce). The parties submit to the Jurisdiction of the Courts and Tribunals of Valencia, expressly waiving their own jurisdiction, should it be different.

You are informed that your personal data will be incorporated into a file owned by LABORATORIOS HERBITAS S.L, the purpose of which is to send you information of interest about our company's products or services.

The legal basis that legitimizes us to process personal data for the aforementioned purpose is the consent expressed by completing and submitting the online form.

Data will not be transferred or communicated to third parties, except in the cases provided by law, or necessary for the development, control, and fulfillment of the expressed purpose(s), as specified, or in specific cases expressly informed to the User.
